Ziketstore Terms of Use
This document is an electronic record in terms of the Information Technology Act, 2000, and the rules thereunder, as applicable, including the amended provisions pertaining to electronic records in various statutes as updated by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.
This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, which mandate the publication of rules, regulations, privacy policy, and Terms of Use for access or usage of the domain name [www.ziketstore.com] (“Website”), including its related mobile site and mobile application (hereinafter referred to as the “Platform”).
The Platform is owned and operated by Ziketstore, a startup with its registered office located at Nigam Road, Selaqui Industrial Area, Dehradun, Uttarakhand 248011, India.
Your use of the Platform, along with its services and tools, is governed by the following Terms and Conditions ("Terms of Use"). These terms are applicable to the Platform, including the associated policies incorporated herein by reference. If you transact on the Platform, you shall be subject to the policies relevant to such transactions. By merely using the Platform, you agree to contract with Ziketstore, and these Terms of Use, including the policies, constitute your binding obligations with Ziketstore.
For the purpose of these Terms of Use, wherever the context requires:
● "You" or "User" refers to any natural or legal person who has agreed to become a buyer on the Platform by providing Registration Data during the registration process as a Registered User using the Platform's computer systems.
● The term "We," "Us," or "Our" refers to Ziketstore.
Ziketstore allows Users to browse the Platform or make purchases without requiring registration.
IMPORTANT: ACCESSING, BROWSING, OR OTHERWISE USING THE PLATFORM INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS SET FORTH UNDER THESE TERMS OF USE. PLEASE READ THEM CAREFULLY BEFORE PROCEEDING.
By impliedly or expressly accepting these Terms of Use, you also accept and agree to be bound by Ziketstore’s Policies (including, but not limited to, the Privacy Policy available at [Privacy]) as updated from time to time.
Membership Eligibility
Transactions on the Platform are available only to individuals who can form legally binding contracts under the Indian Contract Act, 1872. Persons classified as "incompetent to contract" under the Indian Contract Act, 1872—including undischarged insolvents and others—are not eligible to use the Platform.
If you are a minor, i.e., under the age of 18 years, you may access and use the Platform or its content only with the prior consent and supervision of a parent or legal guardian.
In the event that a minor wishes to transact on the Platform, such transactions must be undertaken by the minor’s legal guardian or parent. Ziketstore reserves the right to terminate your membership and/or restrict your access to the Platform if it is brought to Ziketstore’s attention—or discovered—that you are under 18 years of age and are transacting on the Platform without proper authorization.
Your Account and Registration Obligations
By using the Platform, you are responsible for maintaining the confidentiality of your Display Name and Password. You will be held accountable for all activities conducted under your Display Name and Password. If you provide any information that is untrue, inaccurate, outdated, or incomplete, or if we have reasonable grounds to suspect such discrepancies, Ziketstore reserves the right to suspend, terminate, or block access to your membership indefinitely and deny you further access to the Platform.
Your mobile phone number and/or email address serve as your primary identifiers on the Platform. It is your responsibility to ensure that these details are accurate and up-to-date at all times. In the event of a change to your mobile phone number or email address, you agree to promptly notify us by updating your information on the Platform through one-time password (OTP) verification.
Ziketstore shall not be held liable for any activities, misuse, or consequences arising from the use of your account, especially if you fail to update your revised mobile phone number and/or email address on the Platform.
If you choose to share or allow others access to your account on the Platform (“Account”) by creating separate profiles under your Account or otherwise, those individuals will have the ability to view and access your Account information. You will be solely responsible and liable for all activities performed under your Account and any resulting consequences.
You must maintain the confidentiality of your Account information, including your username and password, and you are accountable for all activities that occur under your Account. Sharing your login credentials with others constitutes a breach of these Terms of Use.
You agree to:
1. Log out of your Account at the end of each session.
2. Immediately notify Ziketstore of any unauthorized use of your Account.
If we suspect a security breach or misuse of your Account, we may require you to change your password or, at our discretion, suspend your Account for a period of time deemed appropriate. Ziketstore shall not be liable for any loss or damage resulting from your failure to comply with these obligations.
Communications
When you use the Platform or send emails, data, information, or other communications to us, you acknowledge and agree that you are engaging with us through electronic records. You consent to receive communications from us via electronic records periodically, as needed. We may communicate with you through email or other modes of communication, whether electronic or otherwise, as deemed appropriate.
Platform for Transaction and Communication
The Platform facilitates transactions between Buyers and Sellers, enabling them to connect and engage in commerce. Ziketstore is not and cannot be a party to, nor does it have control over, any transaction conducted between Users of the Platform.
Commercial/Contractual Terms
● All commercial and contractual terms, such as pricing, shipping costs, payment methods, delivery schedules, warranties, and after-sales services, are solely determined and agreed upon between Buyers and Sellers.
● Ziketstore does not influence, determine, or participate in the offering or acceptance of these terms. Discounts and offers, including exchange offers, are provided exclusively by Sellers or Brands, not by Ziketstore.
Order Placement and Cancellation
● Placing an order on the Platform constitutes an offer by the Buyer to purchase the product(s) from the Seller. This does not signify the Seller’s acceptance of the offer. The Seller reserves the right to cancel any order at their discretion, and the Buyer will be informed of such cancellations via email or SMS. Refunds for such cancellations will be processed accordingly.
● Sellers may cancel orders if quantities exceed typical individual consumption limits, based on their discretion. Platform as a Communication Medium
● The Platform serves as a communication medium for Users to buy and sell products or services. Any contracts entered into between Buyers and Sellers are strictly between them. Ziketstore does not own, hold, or claim any rights, titles, or interests in the products or services offered.
● Ziketstore is not liable for delays, unsatisfactory performance, or non-performance resulting from out-of-stock or backordered products. Ziketstore’s Role and Liability
● Ziketstore does not:
○ Represent or warrant the quality, value, or legal compliance of any product or service listed on the Platform.
○ Guarantee that Buyers or Sellers will fulfill their contractual obligations. ○ Mediate or resolve disputes between Buyers and Sellers.
● Ziketstore does not, at any point during a transaction, take possession of or claim title to the products or services offered.
User Responsibility
● Buyers and Sellers must independently verify the authenticity and bona fides of the Users they transact with, exercising their best judgment.
● Ziketstore is not liable for issues arising from User actions, such as fraud or misrepresentation.
GST and Business Purchases
● Certain products may be eligible for business purchases with GST input tax credit benefits. Buyers must provide accurate GSTIN and entity details to avail of these benefits.
● Delivery and billing addresses must align for seamless GST compliance, as per GST Act and rules. Ziketstore is not responsible for verifying GST details or for any denial of input tax credit.
Disclaimer on Pricing
Pricing on the Platform may occasionally reflect errors due to technical issues or typographical mistakes. In such cases, Sellers reserve the right to cancel orders.
Indemnity and Risks
● By using the Platform, Users indemnify and release Ziketstore, its officers, and representatives from any liabilities, damages, or claims arising from User actions or interactions.
● Users acknowledge that there are risks associated with dealing with underage individuals or those acting under false pretenses.
Charges
Ziketstore may charge a nominal fee for browsing and buying on the Platform. Ziketstore reserves the right to change its Fee Policy from time to time. In particular, Ziketstore may, at its sole discretion, introduce new services/fees and modify some or all of the existing services/fees offered on the Platform.
Fee Policy
● Ziketstore may introduce fees for new services or amend fees for existing services as needed.
● Any changes to the Fee Policy will be posted on the Platform and become effective immediately upon posting.
● Unless stated otherwise, all fees are quoted in Indian Rupees.
● Users are solely responsible for complying with applicable laws, including those in India, when making payments to Ziketstore.
What is the Platform Fee?
The platform fee is levied by Ziketstore to sustain efficient operations and ensure continuous improvement of the platform, delivering a seamless and hassle-free app experience for Users.
Refund of Platform Fee
1. Lost or Undelivered Orders:
○ If an order is lost or undelivered to the preferred location, the complete order amount, including the platform fee, will be refunded for online payments.
2. Partial Cancellations or Returns:
○ If a customer cancels an order partially or returns part of an order, platform charges will be refunded proportionally, based on the items being returned or canceled.
3. Full Order Cancellation:
○ Platform charges will be refunded in case of a full order cancellation.
Prohibited Activities, Content, and Conduct on Our Platform
To maintain a secure, respectful, and legally compliant environment for all users, we have established guidelines that clearly define prohibited activities, content, and conduct. These rules apply to all users and interactions on our platform, ensuring its integrity and trustworthiness. By using this platform, you agree to adhere to these standards.
1. Prohibited Content
Users are strictly prohibited from posting, sharing, or engaging with any content that:
1. Infringes Intellectual Property Rights:
○ Content that belongs to another individual or entity without proper authorization, including copyrighted materials, trademarks, patents, or trade secrets.
2. Promotes Harmful or Illegal Activities:
○ Content that encourages or facilitates illegal activities, violence, self-harm, terrorism, or hate crimes.
3. Is Defamatory or Obscene:
○ Material that is slanderous, libelous, obscene, pornographic, or otherwise offensive in nature.
4. Misleads or Harms:
○ Content designed to deceive, mislead, or cause harm, including scams, phishing attempts, or fraudulent claims.
5. Encourages Discrimination or Hate:
○ Material that promotes racism, sexism, xenophobia, or other forms of hatred or discrimination based on race, gender, religion, nationality, disability, or sexual orientation.
6. Contains Malware or Harmful Code:
○ Files, software, or programs that contain viruses, worms, trojans, or any other harmful or malicious elements.
7. Violates Privacy:
○ Unauthorized disclosure of personal or sensitive information about individuals, including addresses, phone numbers, or financial details.
2. Misuse of the Platform
To ensure the proper functioning of our platform, users must refrain from engaging in the following:
1. Unauthorized Access:
○ Attempts to gain unauthorized access to the platform, its systems, or other users' accounts.
2. Automated Tools:
○ Using bots, scrapers, or other automated tools to collect data or interact with the platform.
3. System Overload:
○ Engaging in activities that strain, overload, or disrupt the platform’s infrastructure or services.
4. Reputation Harm:
○ Actions that damage the reputation of the platform, its users, or associated entities.
5. Spam and Unsolicited Communication:
○ Sending spam, chain messages, or unauthorized promotional material to other users.
3. Legal Compliance
Users are required to comply with all applicable laws and regulations, including but not limited to:
1. Prohibited Goods and Services:
○ Avoid conducting transactions involving items or services that are illegal or restricted by local, national, or international laws.
2. Accurate Representations:
○ Represent products, services, or information truthfully, without exaggeration, misinformation, or omissions.
3. Compliance with IT Laws:
○ Adhere to all provisions under the Information Technology Act, 2000, and related rules.
4. Content Responsibility
1. User Responsibility:
○ Users are solely responsible for the content they post, share, or interact with on the platform.
2. Platform Oversight:
○ The platform reserves the right to monitor, review, and remove any content that violates these terms.
3. Liability:
○ Removal of prohibited content does not absolve users of legal or financial liability.
5. User Conduct
1. No Solicitation:
○ Users must not solicit other users or advertise products/services without explicit permission.
2. Identity Integrity:
○ Users must not misrepresent their identity, impersonate others, or create false accounts.
3. Public Safety and National Security:
○ Users must not engage in activities that threaten public order, national unity, or security.
6. Data Privacy and Usage
1. Licensing User Information:
○ By using the platform, users grant us a license to use their information in accordance with our Privacy Policy.
2. Legal Disclosures:
○ We may disclose user information to law enforcement or other authorities as required for legal or investigative purposes.
7. Platform Rights
1. Message Limits:
○ To prevent misuse, we reserve the right to limit the number of messages or interactions users can perform.
2. Content Moderation:
○ We may monitor, edit, or remove content at our sole discretion if it violates these guidelines.
Adhering to these rules ensures a safe, inclusive, and functional platform for everyone. Violations may result in account suspension, legal action, or permanent bans. If you have any questions about these guidelines or suspect any violations, please contact our support team immediately.
Privacy Statement
We take the protection of your privacy seriously and consider it one of our top priorities. We recognize the importance of safeguarding your personal information, which is one of our most valuable assets. We handle your data, including any sensitive financial information as defined under the Information Technology Act, 2000, with the utmost care.
Your information is stored and processed on secure systems, protected by both physical and reasonable technological security measures, in compliance with the Information Technology Act, 2000, and its associated rules.
For detailed information about how we protect and manage your data, please refer to our full Privacy Policy. If you do not agree with how your information is handled or transferred, we kindly ask that you refrain from using our platform.
Disclaimer of Warranties and Liability
The Platform, including all materials, products (including software), and services made available to you through this site, are provided on an "as is" and "as available" basis. We make no representations or warranties, express or implied, except as explicitly stated in writing.
Without limiting the generality of the above, Ziketstore does not guarantee that:
● The Platform will be continuously available, or available at all; or
● The information on this Platform is complete, accurate, true, or non-misleading.
Ziketstore shall not be held liable for any damages or losses, whether direct or indirect, arising from the use of, or inability to use, the Platform, including any content or services provided. Additionally, Ziketstore does not guarantee that the site, its content, materials, products (including software), or services available through the Platform, its servers, or electronic communications sent from us, are free of viruses or other harmful components.
Nothing on this Platform should be construed as advice of any kind. All products sold on the Platform are subject to the laws of different states. If a seller is unable to deliver a product due to state law restrictions, the seller will either issue a refund or provide credit for the amount (if any) received in advance for that product.
By placing an order on the Platform, you will be required to provide a valid phone number. By registering your phone number with us, you consent to receive communication from us via phone calls, SMS notifications, mobile applications, and/or other electronic means, regarding order, shipment, or delivery updates.
Services
Order Fulfillment
When you make a purchase on the Platform, it includes both fulfillment and delivery services. After order confirmation, we will make every effort to deliver your products within the timeframe communicated through the Platform. While we aim to provide accurate estimated delivery times, please note that these times may vary due to factors such as third-party delivery partner availability, order volume, traffic conditions, weather, and unforeseen circumstances. We will not be held liable for any delays in delivery.
For your convenience, the estimated time of arrival (ETA) is displayed on the App’s homepage before you place an order, allowing you to make informed purchasing decisions.
Please be aware that additional delivery fees may apply due to factors like severe weather, peak hours, high demand periods, late-night deliveries, packing and handling, platform maintenance, or small order fulfillment. Any additional fees will be clearly displayed in the "Basket" section before you place your order.
Payment
When using any payment methods available on the Platform, we will not be responsible for any loss or damage arising directly or indirectly due to:
● Lack of authorization for any transactions;
● Exceeding the agreed transaction limit between you and your bank;
● Payment issues arising from the transaction;
● Decline of a transaction for any reason.
All payments for purchases/services on the Platform must be made in Indian Rupees (INR), as accepted within the Republic of India. The Platform will not facilitate transactions in any other currency. Before shipping or delivering your order, the Seller may request supporting documents (including but not limited to government-issued ID and address proof) to verify the ownership of the payment method you used for your purchase. This is done to ensure a safe online shopping experience for our users.
Further: Transactions, transaction prices, and all commercial terms—such as delivery and dispatch of products or services—are governed by the principal-to-principal contractual obligations between the Buyer and the Seller. The payment facility merely facilitates the completion of the transaction between these parties. Ziketstore will not be liable for non-delivery, non-receipt, non-payment, damages, breach of warranties, or after-sales services for any products or services listed on the Platform.
By using the payment facility, you authorize Ziketstore or its service providers to collect, process, facilitate, and remit payments or the transaction price electronically or via Cash on Delivery for transactions on the Platform. Your relationship with Ziketstore is principal-to-principal, and by accepting these Terms of Use, you agree that Ziketstore is an independent contractor and does not control or hold liability for the products or services listed on the Platform that are paid for via the payment facility. Ziketstore does not guarantee the identity of any user nor ensure that a Buyer or Seller will complete a transaction.
You understand, accept, and agree that the payment facility provided by Ziketstore is not a banking or financial service, but a facilitator offering an automated online payment collection and remittance service through authorized banking and payment gateway networks. Ziketstore acts neither as a trustee nor in a fiduciary capacity concerning the transaction or transaction price.
Payment Facility for Buyers
As a Buyer, by initiating a transaction, you enter into a legally binding contract with the Seller to purchase products and/or services using the Payment Facility.
You agree to pay the transaction price through your Issuing Bank to the Seller via the Payment Facility. You, as a Buyer, may communicate electronically with the Seller regarding any extension or increase in the dispatch and/or delivery time using the automated features provided by the Payment Facility. Any amendments to the transaction, such as an extension or variation in dispatch/delivery time, must comply with the Payment Facility's rules and policies.
In case of delivery or non-delivery, you are required to notify the Payment Facility using the appropriate Ziketstore Platform features. If no notification is made within the specified time period, the transaction will be considered deemed delivered. For Cash on Delivery (COD) transactions, confirmation of receipt is not required.
You, as a Buyer, are entitled to claim a refund of the transaction price (your sole and exclusive remedy) if you do not receive the delivery within the agreed timeframe or within 15 days, whichever is earlier. If you fail to submit a refund claim within the stipulated time using the Platform features, you will be ineligible for a refund.
Please note that the Payment Facility may not be available for certain categories of products, services, or transactions as outlined in the policies. In such cases, refunds may not be applicable.
Refunds for non-Cash on Delivery transactions will be processed to the same Issuing Bank used for the transaction or through another available method on the Platform, as chosen by you.
For COD transactions, refunds will be made via electronic payment transfer.
Refunds will be processed in Indian Rupees and will be equivalent to the transaction price received in INR.
For electronic payments, refunds will be processed using NEFT/RTGS or any other online banking or electronic funds transfer system approved by the Reserve Bank of India (RBI).
Refunds are subject to the support of select banks. If your bank is not supported for processing refunds, you will need to provide alternative bank account details.
Refunds are conditional and may be subject to review by Ziketstore for misuse or fraud. Additional documents may be requested for verification purposes.
Refunds will be processed only if the Buyer complies with the Platform's policies.
Ziketstore reserves the right to impose limits on the number of transactions or the total transaction amount that may be processed using a valid credit/debit card, bank account, or any other financial instrument. Ziketstore also reserves the right to refuse processing transactions exceeding such limits.
Ziketstore reserves the right to refuse transactions from Buyers with a history of questionable charges, including breaches of agreements, violations of laws, or issues with the Issuing Bank.
Ziketstore may conduct checks at its discretion before approving the receipt of or commitment to pay the transaction price, especially for high transaction volumes or suspicious activities. If Ziketstore is not satisfied with the Buyer's credibility or the legitimacy of the transaction, it may reject the receipt or commitment to pay the transaction price. For clarity, the Cash on Delivery option may be disabled for certain users at Ziketstore's discretion.
Ziketstore may delay confirming payment or notifying the Seller to dispatch if it deems the transaction suspicious or if the Buyer is conducting high volumes of transactions. In certain cases, Ziketstore may withhold the transaction price and inform law enforcement instead of refunding the amount to the Buyer if illegal activity is suspected.
Both the Buyer and Seller acknowledge that Ziketstore will not be liable for any damages, losses, or claims resulting from delays or non-processing of a transaction or transaction price due to circumstances beyond Ziketstore's control.
Customer Conduct
At Ziketstore, we are committed to fostering a diverse, inclusive, and equitable environment for everyone involved with our platform, including our delivery partners. We protect individuals from any form of discrimination, ensuring they are treated with dignity and respect.
Terms:
A) Ziketstore promotes diversity, inclusion, and equity, safeguarding delivery partners from discrimination based on race, social origin, caste, ethnicity, nationality, gender, gender identity and expression, sexual orientation, disability, religion, belief, age, or any other protected characteristic.
B) Discrimination against delivery partners is strictly prohibited under all circumstances, including but not limited to factors such as race, religion, caste, place of origin, disability, sexual orientation, sex, marital status, gender identity, age, or any other attribute protected by applicable law.
C) We reserve the right to restrict or suspend your access to the Platform at our sole discretion if you engage in discourteous, disrespectful, or abusive behavior toward any delivery partner working with Ziketstore, or if your conduct is deemed inappropriate or unlawful.
D) All customers are expected to treat delivery partners with courtesy, respect, and professionalism at all times.
Trademark, Copyright, and Restrictions
This site is operated and controlled by Ziketstore, with products sold by respective Sellers. All content on this site, including but not limited to images, illustrations, audio clips, video clips, and other materials, is protected by copyrights, trademarks, and other intellectual property rights.
The materials on the Platform are provided solely for your personal, non-commercial use. You may not copy, reproduce, republish, upload, post, transmit, or distribute any content from the Platform in any form or by any means, whether electronically, mechanically, or otherwise, including by email or other digital communication, either directly or indirectly. You are also prohibited from assisting others in doing so.
Modification of the materials or their use in any other platform or networked computer environment, or for any purpose other than personal, non-commercial use, without the prior written consent of the copyright or trademark owner, is a violation of intellectual property rights and is strictly prohibited. Any usage for which you receive compensation, in money or otherwise, is considered a commercial use for the purposes of this clause.
Trademark Complaint
Ziketstore respects the intellectual property rights of others. If you believe that your trademark has been infringed upon, please notify us by sending an email to Ziketstore@gmail.com. We will address your concerns promptly.
Product Description
At Ziketstore, we strive for accuracy, but we do not warrant that the product descriptions or any other content on this platform are complete, reliable, current, or error-free. We disclaim any liability for inaccuracies or errors in the product descriptions or other content provided on the platform.
Limitation of Liability
In no event shall Ziketstore be held liable for any special, incidental, indirect, or consequential damages arising from or related to these Terms of Use, even if Ziketstore has been advised of the possibility of such damages.

Profanity Policy
Ziketstore is committed to fostering a respectful and welcoming environment for all users. We strictly prohibit the use of language that is racist, hateful, sexual, or obscene in any public area on our platform.
This policy applies to text within listings, seller pages, and all other areas of the site that can be viewed by other users. If offensive language appears in a product title, sellers are allowed to 'blur' out the majority of the offending word using asterisks (e.g., s*** or f***), as long as it doesn't violate the policy.
Reporting Violations:
If you encounter any violations of this policy, please report them through the appropriate channels for review:
● Report offensive Display Names
● Report offensive language in a listing or elsewhere
If profanity is found in feedback comments, user communications, or email exchanges related to transactions on the platform, please refer to our feedback removal policy and submit a request for action or removal.
Disciplinary Actions:
Ziketstore may take disciplinary actions based on the severity of the violation, including:
● Indefinite suspension of the user’s account
● Temporary suspension of the user’s account
● Issuing a formal warning We will consider the circumstances surrounding the alleged violation and the user’s trading history before taking action.
Possible Consequences of Violations:
● Restrictions on account privileges
● Loss of special status
● Account suspension
Ziketstore reserves the right to remove any product review that contains offensive language, as outlined in this policy. Additionally, if a review is deemed unfair — for example, if it negatively impacts a product or artificially boosts its popularity — we reserve the right to delete the review. Ziketstore may also, at its discretion, blacklist the customer from posting any further reviews.
Email Abuse & Threat Policy
At Ziketstore, we value professional, respectful communication and encourage our users to maintain a courteous tone when engaging via email. While we do not regulate private email correspondence, we take the following violations seriously and will investigate accordingly:
Prohibited Activities:
1. Threats of Bodily Harm:
Ziketstore strictly prohibits any threats of bodily harm. Such behavior is not tolerated on our platform.
2. Misuse of the Ziketstore System:
Ziketstore allows users to facilitate transactions through our platform. Any misuse of the system will be thoroughly investigated and addressed.
3. Spoof (Fake) Emails:
Ziketstore will never ask for sensitive information via email. If you receive a fake email attempting to collect your personal information, please report it to us through the 'Contact Us' tab immediately.
4. Off-site Transactions:
We prohibit any offers to buy or sell products outside of the Ziketstore platform. Such offers pose significant fraud risks for both buyers and sellers.
Zero Tolerance for Threats:
Ziketstore does not tolerate threats of physical harm made through any communication method, including phone, email, or public message boards. This policy is strictly enforced to ensure the safety and integrity of our platform.
Consequences of Violations:
Violations of this policy may result in actions including, but not limited to:
● Restrictions on account privileges
● Suspension of account access
● Cancellation of listings
● Loss of special status
We are committed to maintaining a safe and trustworthy environment for all users. If you encounter any abusive or threatening behavior, please report it promptly so we can take appropriate action.
Policy changes
